They also ignored the 4th. Amendment which guarantees a person the right to be secure in their persons, and the 5th. Amendment which guarantees a person the right to life absent due process of law as does the 14th.
That is why they had to be certain that they cast the babe in the womb in the light of "non-human" so as to deprive them the right to life. Much the same argument was made in the deciding of Plessey.
Also in Roe a fact that is often overlooked was the comment by the Court that if science should ever determine that life began at conception then their ruling would be moot. So, even though the majority of scientists support the belief that life begins at conception the Court now rules that it would have an adverse effect on society to reverse Roe since abortion has now become the custom of the land.
