Is the statement of that fact discriminatory?
Absolutely.
If a just and moral cause can be shown, for a negative discrimination, it becomes justified and to apply negative discrimination becomes the right thing to do.
Every good law is permission and a compulsion for us to discriminate negatively against those who break the law. This is good.
If it is a bad law then the reverse would apply.
