well lets see, an actual judge thinks its worth at least taking a look at.  seems like thats simply being fair.  the defense not bothering to show in addition to being the height of arrogance (or contempt ?) is just depriving it's client representation in the matter.I'm kind of curious to see if the local suit they hired to argue there suffers repercussions for this conduct.
