I'm not so much interested what he requests or her decision. Is she obeying the law?

Good question and one which proponents on both sides are arguing, sometimes for the prevalent opinion and something opposed to the prevalent opinion. It is not laws that are unclear so much today as it is the minds of lawyers and lawfare practitioners that are muddied about what should be right interpretations of the law.
